- With the exception of projects funded with EDA disaster supplemental funding, Appendix A (below) should be signed by the Recipient’s Authorized Representative and submitted to the EDA Project Engineer prior to or along with the plans and specifications (do not include Appendix A in the specification documents).

Please note that Executive Order 11246 (“Equal Employment Opportunity”) was revoked by Executive Order 14713 (“Ending Illegal Discrimination and Restoring Merit-Based Opportunity”), on January 21, 2025. Accordingly, on July 1, 2025, the Department of Labor (“DOL”) proposed recission of the regulations at 41 CFR § 60-1.4 and 41 CFR § 60-4 which implement Executive Order 11246. In addition, current DOL policy, subject to change, is that the written notifications to the Director of the Office of Federal Contract Compliance Programs required by these regulations are not being accepted and DOL is not enforcing the provisions per Secretary's Order 03-2025 as modified by Order 08-2025. Recipients and contractors should monitor DOL guidance to ensure compliance with current requirements.
Once the regulations are rescinded, EDA will update its requirements. Until such time as the regulations are rescinded or unless there is additional DOL guidance, the Contractor agrees to comply with all applicable requirements of 41 CFR § 60-1.4 and 41 CFR § 60-4. - EDA Contracting Provisions for Construction Projects (PDF)
